Present:  Chair Anna Andregg; Commissioners: Dan Howard, Michael Hinckley and Richard Hirschi, Allen Bice; Staff:  Kyle Gubler, Derek Imlay, Kevin Bennett, Katie Wilson; Public:  Ray Justice, Chris Balling, Becky Marchal, Kris & Tawni Yadley, and Dave & Madalan Wilson

 

Joe Webb and Robert Holland were absent.

 

Call to Order:  Chair Anna Andregg at 6:03 pm.  Invocation and pledge of allegiance by Allen Bice

 

Approval of Minutes:  2 changes were made to the December 8, 2010 minutes.  1) Michael is misspelled and 2) on page 3, 2nd paragraph should be changed to 3% replacing 20%.

 

Motion by Commissioner Bice to approve the amended minutes of December 8, 2010 regular meeting, second by Commissioner Hinckley.  Motion carried with Andregg, Hinckley, Hirschi, Bice and Howard voting yes.

 

Approval of Agenda:  one change was made to the agenda.  A and B in section V. Public Hearings and Possible Action were switched.

 

Motion to approve the amended agenda by Commissioner Hirschi, second by Commissioner Bice.  Motion carried with Andregg, Hinckley, Hirschi, Bice and Howard voting yes.

 

Reports:

•1.      Beautification Committee:  Allen Bice - still moving forward with the Crescent Project.  Heard from the architect at University of Utah and the committee is waiting for cost estimates and plan on funding the project with through private source and matching grants.

•2.      Economic Development Committee:  none

•3.      Trails Committee:  none

•4.      Director of Operations:  Derek Imlay - The City is finalizing the filter project and did a final walk through with Sunrise Engineering.  There were a few minor changes and they are still working on the electrical which is a separate contract.  On March 1st he will be testing the system and if the tests are good then the city will turn on the irrigation water on March 15th.

 

On Thursday or Friday of this week, Maverick will be coming in to pay their permits.  They have been trying to locate the utilities.  Their goal was to open March 1st but that is not achievable so it will be closer to the end of March.  They will be tearing everything except for the exterior walls down in their reconstruction.  Maverick will be paving the lot behind the station and adding 2 more filler stations there for RV and trucks.

 

The City is putting a new irrigation line to replace a damaged line in the Gateway properties.  Right now there is a 2 inch line but there has been a lot of damage to it.  They will be putting in a 6 inch line and bring them up to specs and adding connections to homes and lots without current connections.

 

Along 100 East as it connects to 400 North - an abandoned water line will be converted to an irrigation line with new yokes and new meters so everyone on 400 N will have access to irrigation water.

 

Commissioner Hinckley questioned Derek about the work on Main Street.  Derek responded by explaining that the School District bought property from Interstate Rock and the main transmission line for phones are going up on larger poles.  Main Street will be extended north and there will be a road connecting SR-17 to Main Street as part of the project.  Under contract, it all has to be pad ready.

 

Public Hearing and Possible Action:

  • A. Amendment to Public Facilities Zone: Kevin Bennett explained that in September 2010, on recommendation from Planning Commission, the City Council created a public facility zone. This amendment will clarify a mistake made and add a definition of "quasi-public". It also lays the groundwork for Questar and other utilities.

 

Anna opens to public hearing:

David Wilson asked if the amendment will affect the zoning.  He is answered that it will not affecting the zoning.  Kevin Bennett explained to him that this amendment is better for residents and gives them more rights.

 

•B.     Questar is requesting a zone change for regulator station located at approximately 1200 N State Street (just north of the 4-plex at 1045 N State St):

David Wilson asked these questions: If a welding shop or a gas station was placed and created a spark would that create a problem or explosion?  Or if a truck ran into it or a back hoe hit the Regulator Facility would there be an explosion?  Is over pressure on the pipes ever a problem?  Is there a release valve in place or will be?  Will it make a difference in property values?  Inlet/outlet valves, safety pressure valves?  Flow rate, velocity of gas?  Is there a metering station?  What size pipe?  What pressure?  Will there be any kind of noise-level?  Will it be environmentally friendly as far as gas leaks?  Will it be a danger to anyone around or create a problem, gas into the atmosphere?

 

Kris Yardley asked if Questar would be digging another gas line or will they be hooking up to the existing line?  And if they dig, where would that happen?

 

Chris Balling explained to the public and the commission the reason for the new regulator station.  He explained about the birdcage already in existence.  It has an 8 inch main line and the new station will take off that line reducing the pressure.  The birdcage is a hazard and needs to be upgraded and with the growth in the area there is a need for a bigger station.  It will intermediate the high pressure.  This station is not a lot different than the birdcage except that it will handle a larger volume.  The station will be a 50x75 feet building with a decorative concrete wall around it.  It will be set to the back of the property away from the road and hidden behind the canal.  It will have a locked gated fence at the entrance.  The pressure will be the same as in the park (birdcage) but this regulator station will be enclosed and Questar will be pulling the birdcage out.  The property values should not change as they will be building it so it looks nice and the pipe will be the same size as it is now.  The building will be insulated and it will be no noisier than the birdcage or the trucks passing by on the road.  Environmentally it will blend into the surrounding area.  The danger for leaks will be same as it is now but with the new building it will be safer from vandals.  This new regulator station will be the exact same as the one on the west end of Hurricane City.  The pipe is in an easement under the river.  Questar will be running a 4 inch line in that same easement hooking up to where the birdcage is now.  Questar will re-vegetate and fix any damage to property and they will begin construction this spring or summer.

 

Derek mentioned the utility meeting and that all the utility companies looked over the proposed Questar plans and had no issues with it and they all signed it.  The City likes the new location and it is better than in the park.

Business:

•A.    Recommendation on Amendment of the Public Facilities (PF) Zone: 

 

Recommendation to approve the Amendment of the Public Facilities (PF) Zone made by Commissioner Hirschi, second by Commissioner Hinckley.  Recommendation carried with Andregg, Hinckley, Hirschi, Bice and Howard voting yes.

 

•B.     1. Approval for Questar property placement in PF Zone:

The commission takes 5 minutes to read over the ordinance.

 

Kevin explained section 2 of the ordinance. The Planning Commission may recommend conditions to be put into the ordinance.  Derek explained that the station will have to abide by the building and city codes.  Chris Balling explained that a gate, a paved road into the facility and gravel within the compound is planned.

 

The Planning Commission adds the condition "placement of a decorative concrete wall" to be added to the ordinance.

 

Motion to approve the ordinance amending the zoning map for the City of La Verkin and providing for a natural gas collection, regulator and distribution system; and provide an effective date with the provision that it have a decorative concrete wall in Section 2 in accordance with the agreement by Commissioner Bice, second by Commissioner Hirschi.  Motion carried with Andregg, Hinckley, Hirschi, Bice and Howard voting yes.

 

Derek takes this time to thank Questar for the easement they are donating to the city for a future "Welcome to LaVerkin" sign, like the one at the south end of town by the bridge.

 

•C.    Receive input on the Drainage Study:  Derek explained.  The engineer requested to be a part of City Council at the end of this month but will be putting them off until the February 2nd City Council meeting.  The information, at Kevin Bennett's request, will be coming in this week so it can be sent to Planning Commission for review. 

 

Anna Andregg has the same concerns as last meeting.

 

Allen Bice believes that the city should use natural drainage wherever possible.  He would like to preserve the natural drainage courses of water to the river instead of piping the water.  Every place that can use natural drainage should use it.

 

Kevin Bennett - Katie sent a copy of the last meetings minutes to the engineers of the drainage study and will send a copy of tonight's minutes also.  Engineers can make things work but the Planning Commission addresses what works for us.

 

Richard Hirschi - What needs to be looked at also is drainage of things other than water, referring to Maverick and gas drainage. Derek responded by stating the Maverick station will be putting in a detention basin on their property.  EPA states that gas tanks must be placed in vaulted holding areas underground with access to maintain those tanks.  There must also be leak detections in place.  The city is allowing Maverick to connect into the drainage system.  Maverick has a container that has an outlet on the top that contaminants will settle in the bottom of the cleaner so water will be cleaner going into the drainage.  MS4 - all water going to the river will soon be required to be cleaned and quality & quantity will be monitored.  The trash and debris will have to be filtered before the water can run into the river.

 

Dan Howard - remarked that catch basins sound good.  He also stated that any mistakes the engineers make will reflect on the city and not on the engineers.  Engineers are only on the hook for a year, or after the city approves the plan and the city will have to live with those mistakes.  Mistakes were made previously with the road system that the city is still having to address.

 

Kevin Bennett wanted this discussion to come before the Planning Commission before going to the City Council although bringing it before the commission is not part of the process.
