A.     Status update on issues relative to large developable property.  What can be done with it?

Present: Chairman Anna Andregg:  Commissioners:  Michael Hinckley, Richard Hirschi, Allen Bice; Staff:  Derek Imlay, Katie Wilson; Public:  Ray Justice, Randy Reeve, Dana & Tyler Randall

I.              Call To Order: Invocation and Pledge of Allegiance by Allen Bice

II.           Approval of Minutes:

Motion made by Commissioner Richard Hirschi to approve the minutes as written, second by Commissioner Anna Andregg.  Motion carried unanimously.

III.         Approval of Agenda
Motion made by Commissioner Michael Hinckley to approve the agenda as written for Wednesday, September 14, 2011, second by Commissioner Allen Bice.  Motion carried unanimously.

IV.        Reports:
A.     Beautification Committee - Commissioner Bice reported on the Sports Complex on Ash Creek SSD property in Riverwood.  They hopefully have enough private donations to cover phase 1, which is to put grass seed in and water it.

B.     Economic Development Committee - no one to report

C.     Trails Committee - The committee has not met.

D.     Director of Operations -
1.      There are a couple of subdivisions in the process of reopening. Cherry Orchard Phase 3 and Sunset View Estates.  A group out of Salt Lake City has bought Sunset View and must go through the process again.  This is the subdivision by the water tank.  Commissioner Andregg asked if there was a concern that this subdivision reopening would affect the Hillside Ordinance.  Derek believed that everything is already disturbed that could be disturbed.  There should not be any further scarring of the hillside.  He also believed they will follow the same plan.

There was a discussion about 400 North improvements and the entries into the Sunset View subdivision.  The roadways in the subdivision are the standard 50 foot width.

2.      The filter station is shut off right now because of the rain.  When the turbidity comes down they will turn it back on.

3.      Staff has started an electronic meter replacement program.  By spending approximately $3000 per month the city is changing out 10-12 manual meters to electronic and putting in the required backflow devices.  Staff is beginning in Stowell's on 380 North.  These new meters are warrantied for 20 years, 10 years at 100% and the 2nd 10 years prorated.  Forty man hours are used now to read the meters in the city.  If they were all electronic read meters, the whole town could be read in 3-4 hours.

4.      Mustang Motors has approval and a license for auto repairs.  They are waiting for the State to approve a license for auto sales.  They are using the south side of the building by the new animal shelter.'

5.      The footings are poured for the Animal Shelter.  On Tuesday the floors will be poured and Derek expects completion by mid-November.  The block is 16x12x8 split face block fully grouted and epoxied. These blocks should cut down on sound. Derek expects to be finished by the middle of November.

V.           Business:
A.     Status update on issues relative to large developable property.  What can be done with it?
Commissioner Andregg stated that this is a discussion of issues in the past.  Derek reminded the Commission to keep the conversation general about private drives and multiple family dwellings on a single property.

Commissioner Andregg referenced the Bourgoin property stated that there is no allowance for police enforcement, they cannot build without approval of the Sewer Board as there is no sewer there presently, and the family does not want a public street in their family compound.  The controversy seems to be they want it but do not want to finance it.  Commissioner Andregg wondered if it was even possible.

Derek answered by stating that if property owners do not want to subdivide then the city has no other way for them at this time.  One issue concerns a parcel that, in order to access it must pass through 3 other parcels of private property.  If the owners can come into an agreement the road would be a shared private road.  They do not want a 50ft wide road at this time but the fire code says a minimum of 26ft.  The city recommends making the road 50ft on the plat in case there is a subdivision later and making setbacks from the 50 ft mark.

There was a discussion of the existence of water, flow rates and compaction.

There is no parking on a road that is only 26ft and the no parking policy would have to be enforced by the property owners, not the city.

There was a discussion of septic tanks vs. sewer system.  The Sewer Board does not allow septic systems to be installed.

There must be a minimum of 6 acres for this to work.  There are multiple properties in La Verkin that this could affect.  Some owners do not want the cost of making a subdivision.

There was a small discussion of putting a business on a private road.

Derek explained properties situated in a flood plain and the requirements of these properties.  Land in the flood zone would have to be brought up to FEMA standards and studies are required.

A cud-de-sac or a hammerhead would be required at the end of private road.

Private drives limit the city's responsibility on them.

There was a discussion of lot size requirements.  There is nothing that can be done without an ordinance made.

Derek stated that this is an item on the Planning Commission priority list for the year and he would like to bring it back to the Commission and invite the parties involved to the meeting.

Council-member Ray Justice explained the City Council's point of view to the Commission.

Commissioner Allen Bice would like to allow people to do what they want to their own property as long as it is in the interest of the city.  He would like to see an ordinance established to help these property owners if it does not cause the city any problems.

Derek stated that the owners will have to be held responsible.  There are certain health and safety issues and the property owners will have to meet those criteria.

Council-member Justice reminded the Commission that the parcels are large now but may not always remain that way and new owners may want to subdivide.  There needs to be a plan in place.  He stated that the owners need to plan for a 50ft road so things do not have to be changed later.

There was further discussion of the septic and sewer system.

There was a discussion of owners wanting to cluster homes on their property but later may want to subdivide.  There must be at least 300ft of frontage for 3 homes.  The owners should want to lay the homes out in case there is a subdivision later.

There was a discussion of an ordinance that has been taken out of the Code Book.

Derek explained that the property owner will be responsible for the utility bills; 1 water meter, 1 gas meter, 1 power meter, etc.  If the owner does not pay the bill then everyone on the property would be shut off.  By having separate meters they are essentially subdivided without paying the impact fees.

Derek also explained that it could be permissible if 70% of the land is open space.

There was a discussion of conformity in the future.

Derek explained this may come back at the first of the year.  He would like to gather the thoughts of the Planning Commissioners and get a list of their concerns and ideas.

He also explained that there are certain issues still on the table and being discussed with property owners.

VI.        Motion made by Commissioner Michael Hinckley to adjourn, second by Commissioner Richard Hirschi.  Motion carried at 6:52pm.
